ERIC HERSCHMANN

Eric Herschmann served as a legal advisor to Trump during his time in office and was involved in many of the legal battles that arose in the aftermath of the 2020 election. Despite his loyalty to Trump, Herschmann has been vocal in his opposition to the former President's claims of fraud, which he believes to be unfounded and without evidence. He’s also been clear that continuously pushing the election fraud claims with no evidence is illegal. 

 

In correspondence with the White House, Herschmann expressed his misgivings with the legal arguments behind the attempt to overturn the election—as well as the lawyers who came up with it.

“I certainly am not relying on any legal analysis from either of you or Boris who — to be clear — I think is an idiot,” former Trump White House lawyer Eric Herschmann emailed Trump’s personal lawyers Evan Corcoran and John Rowley regarding Trump’s advisor turned “in-house counsel” Boris Epshteyn.

 

“When I questioned Boris’s legal experience to work on challenging a presidential election since he appeared to have none — challenges that resulted in multiple court failures — he boasted that he was ‘just having fun,’ while also taking selfies and posting pictures online of his escapades,” Herschmann went on. 

After January 6th

In a taped deposition played during a Jan. 6 hearing, Herschmann testified that he told John Eastman, one of Trump’s attorneys who is credited with the legal plot to overturn the election, the day after the Capitol riot: "I only want to hear two words coming out of your mouth from now on, 'orderly transition'."

 

Herschmann told the committee Eastman eventually repeated the words back to him.

"Now I'm going to give you the best free legal advice you're ever getting in your life," Herschmann testified he added. "Get a great f'ing criminal defense lawyer. You're gonna need it."
